Terms of Service

By accessing or using the Freehold platform at getfreehold.com (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

The Service is operated by Freeholder, Inc. ("Freehold," "we," "us," or "our"). These Terms govern your use of the Service as an individual or on behalf of an entity.

All deal analysis reports are generated using standardized, publicly documented assumptions (e.g., a fixed down payment percentage, interest rate, and expense ratios). These assumptions may not reflect your actual financing terms, local market conditions, or the true operating costs of a specific property.

You should not rely solely on Freehold outputs to make any investment decision. Always conduct independent due diligence, consult a licensed real estate broker, financial advisor, or CPA before purchasing any property. Freehold does not guarantee the accuracy, completeness, or fitness for purpose of any analysis.

You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. By using the Service, you represent that you meet these requirements.

To access certain features you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@getfreehold.com if you suspect unauthorized access.

You may not share your account with others or use another person's account without permission. We reserve the right to terminate accounts that violate these Terms.

You may use the Service for lawful personal or commercial real estate investment research. You may not:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Reverse-engineer, scrape, or systematically extract data from the Service
• Attempt to circumvent any rate limits, access controls, or security measures
• Resell or redistribute outputs from the Service as a standalone data product without our written consent
• Use the Service to generate analyses for properties you do not have a legitimate interest in evaluating
• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit viruses, malware, or other harmful code

Free accounts are subject to usage limits on the number of deal analyses that can be performed per month. Limits are subject to change with reasonable notice. Excessive or abusive use that negatively impacts the Service for other users may result in temporary or permanent throttling or suspension.

The Service uses Anthropic's Claude API to generate deal analyses. Property queries are transmitted to Anthropic's servers for processing. We are not responsible for the availability or actions of third-party services. Your use of the Service is also subject to Anthropic's usage policies.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of any analysis, estimate, projection, or recommendation generated by the Service. Real estate markets are inherently unpredictable; past results are not indicative of future performance.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FREEHOLDER, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify and hold harmless Freeholder, Inc. and its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for breach of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination shall survive (including Sections 2, 7, 9, 10, and 11).

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any disputes arising out of these Terms or the Service.

We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes.
